Pundit ClaimsAI claims by Gary Marcus and Ed Zitron, with the evidence

“Two reasons, first, because I believe that more incidents like this will happen, perhaps many more, hundreds or thousands, given how rapidly chatbots are being deployed, and the near total lack of regulation on how they can be used.”

The first known chatbot associated death, paragraph 11. The full statement is at the source.

Our reading, the sentence that was checked:

There is a near-total lack of regulation on how chatbots can be used, and they are being deployed rapidly.

From the speaker

  • how rapidly chatbots are being deployed
  • the near total lack of regulation on how they can be used

Our interpretation

  • Assess only the observation identified by the screens, not the surrounding prediction of additional deaths.
  • Read rapid deployment as substantial public rollout and uptake over weeks or months.
  • Read regulation ordinarily to include binding existing laws governing chatbot services and their use, whether or not written specifically for chatbots.
  • No jurisdiction is specified. Assess the broad statement against major markets, without treating one isolated legal restriction as sufficient to refute near-total absence.
  • Use the latest completed quarter and the immediately preceding days, January 1 through April 4, 2023, to describe the ongoing rollout and regulatory state.

Counts as supported if: Evidence shows rapid public deployment and uptake, while binding constraints on chatbot services and their use are largely absent across major markets.

Counts as contradicted if: Evidence shows slow or limited deployment, or substantial binding constraints on chatbot services and their use across major markets. Opposite findings for the two components warrant mixed.

Retrospective: these criteria were written after the outcome was public.

Rationale

Rapid deployment is supported by Bard's public rollout and Bing's substantial early uptake. The broad regulatory claim is overstated: Italy was already restricting ChatGPT under privacy law, and China had binding rules explicitly covering intelligent dialogue and generated text. These were substantial constraints in major markets. They do not establish that protections against harmful psychological advice were adequate. A narrower claim about those protections could receive a different assessment.

Limitations

  • The result depends on reading regulation to include existing binding law.
  • This is not a comprehensive worldwide legal census.
  • Bing uptake is documented through contemporaneous reporting because the original announcement could not be retrieved.

Evidence (4 items)

  • Supports the claim: Google,

Today we’re starting to open access to Bard

Why it matters here: Google opened public access to another major chatbot during the same period as Bing's rollout. Together with e2, this supports rapid deployment.

  • Supports the claim: MobileSyrup,

a “million plus new Bing preview users.”

Why it matters here: The report identifies more than a million preview users and over 45 million chats during the initial rollout. Its separate figure for total Bing users is not treated as a chatbot-user count.

  • Goes against the claim: Italian Data Protection Authority,

processing data in breach of privacy laws.

Why it matters here: The authority imposed an immediate temporary restriction on processing Italian users' data and identified privacy and child-protection deficiencies. This demonstrates enforceable constraints on chatbot operation, although it does not establish comprehensive mental-health safeguards.

  • Goes against the claim: Cyberspace Administration of China,

    任何组织和个人不得采用技术手段删除、篡改、隐匿

Why it matters here: These binding rules cover intelligent dialogue and generated text, with content-management, identification and labeling obligations. The quoted provision prohibits removing or concealing required labels; together with e3, the rules contradict a broad reading of near-total regulatory absence.
